General terms and conditions of business

§1 Scope
(1) The following general terms and conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed (§ 13 BGB). Entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity.

(3) German is the only contractual language available.


§2 Formation of a contract, storage of the text of the contract

The order is made in the following steps:

§3 Prices, shipping costs, customs clearance
(1) The prices stated on the product pages include the statutory VAT and other price components and may include the respective shipping costs. You will receive further information on the shipping costs directly in the course of the order.

(2) The consumer has the option of paying by PayPal, Klarna, American Express and credit card (Visa, Mastercard).

(3) Additional customs clearance costs abroad, eg for orders from Switzerland, must be borne by the end user (DAP).


§4 Product Specifications and Delivery
(1) The respective product properties of our products (e.g. dimensions, specific weights, properties) are agreed in the respective purchase contract. In particular, when specifying the product size, the maximum dimensions are always given and each product can have measurement tolerances of up to +/- 10cm. These product properties are not guaranteed properties but only commercial designations. There is no guarantee that they will be observed.

(1) Unless we have clearly stated otherwise in the product description, all items we offer are ready for dispatch immediately. The delivery takes place within 1-3 working days. In the case of payment in advance, the period for delivery begins on the day after the payment order to the bank commissioned with the transfer and for all other payment methods on the day after the conclusion of the contract. If the deadline falls on a Saturday, Sunday or public holiday at the place of delivery, the deadline ends on the next working day.

(2) The risk of accidental loss and accidental deterioration of the item sold is only transferred to the buyer when the item is handed over to the buyer, even in the case of mail-order sales.

(3) In the event of delivery problems or if a product is no longer available, we reserve the right not to deliver the ordered product and to send you information about replacement products of the same or higher quality and price, which you can then order. If you do not wish to order such replacement products, we will refund any amounts you may have already paid to us for the unavailable products

(5) Undeliverable shipments: If we are unable to carry out a delivery, we will deposit your delivery in our warehouse for up to 10 days. In this case, you will be left with a message telling you where your order is and how to get it. If you do not contact us to arrange delivery, we will assume that you wish to end the contract and it shall then be deemed to have ended. As a result of the termination of the contract, we will refund the purchase price paid as soon as possible, at the latest within 30 days from the moment the contract is deemed to have ended. In such cases we are entitled to charge you for all shipping costs and other costs resulting from the termination of the contract.


§5 Retention of title
We reserve ownership of the goods until the purchase price has been paid in full.


§6 Right of withdrawal of the customer as a consumer
Returns and Returns
The customer bears the return costs, unless damaged items are delivered. In this case, Icy Buddy will cover the return costs.

If a return label is requested, €3.95 will be charged, which will be deducted from the refund amount.

The customer is free to choose which provider he uses for his return shipment. If the customer falls below a minimum order value by returning the item, any redeemed discount codes that had something to do with a minimum order value expire.

Returns can only be accepted if they are in their original condition with no signs of wear, odors or dirt. If the product is returned to us with clear signs of use, Icy Buddy has the right to refuse the return and send it back to the customer. If the return is refused, the right to a refund of the product costs lapses.

Right of withdrawal for consumers Consumers are entitled to a right of withdrawal according to the following stipulations, whereby a consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.

Consequences of revocation
If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment.

We may refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any event no later than fourteen days from the day on which you inform us of the cancellation of this contract.

The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods.

In the case of cancellation of partial shipments where a discount code is applied to the cheaper product, in the event of cancellation of the higher-quality product, the cheaper product will be recalculated at full price and only the difference will be refunded.

Example: Product A costs €50, product B costs €40 and thus receives a 50% discount, for example. This results in a total purchase value of €70 (€50 + €20). When withdrawing product A with a value of €50, product B will be charged at full price (€40 instead of €20). This only reimburses €30 for product A.

PayPal
During the ordering process, you will be redirected to the website of the online provider PayPal.
